ERA: 1970S CIVIL RIGHTS

The Section 504 Sit-Ins (1977)

In 1973, Congress passed the Rehabilitation Act. Section 504 declared that no program receiving federal money could discriminate against people with disabilities. It was a revolutionary law, but there was a catch: it was just a statement. To make it real, federal departments had to sign regulations explaining how it would be enforced.

For four years, federal officials refused to sign the regulations, fearing the cost of making public buildings accessible. In response, disability rights advocates led by activist Judy Heumann took direct action.

On April 5, 1977, activists marched into federal offices across the country. In San Francisco, over 100 people occupied the Department of Health, Education, and Welfare (HEW) building. They slept on the floor, went on hunger strikes, and refused to leave. After 25 days, the regulations were finally signed.

Two Paths to Equal Access: Section 504 vs. IEP (IDEA)

Today, two major federal laws protect the rights of students with disabilities in school. While they share the goal of equal access, they do so through different mechanisms, standards, and legal concepts.

Civil Rights Protection

Section 504 receives zero federal funding. It is a broad prohibition against discrimination.

Where does the IEP come from?

An IEP (Individualized Education Program) is a specialized legal document that falls directly under and comes from IDEA.

MASSACHUSETTS CHAPTER 766

States as Laboratories of Democracy

In our federal system, the US Constitution divides power between the national government and state governments. Education is a power traditionally reserved for the states. However, the federal government uses civil rights laws and funding to set national minimum standards.

But federalism also allows states to go beyond federal standards. In 1972, three years before the federal government passed the main special education law, Massachusetts passed Chapter 766.

Chapter 766 was a pioneering law that declared children with disabilities had the right to be educated in local public schools alongside peers. When Congress drafted the federal Education for All Handicapped Children Act in 1975 (which was later updated and renamed the Individuals with Disabilities Education Act, or IDEA), they used Massachusetts' law as a direct blueprint!

REGULATORY SPECTRUM

Federal Minimum (FAPE)

Schools must offer a "Free Appropriate Public Education" (an educational program reasonably calculated to show progress).

MA Standard (Ch. 766)

Guarantees a program designed to achieve "maximum feasible development." (Higher expectations).

*Note: Congress adopted 70% of Chapter 766's legal procedures when writing national laws.

Massachusetts can tailor standards to its local population and values, providing stronger services and deeper inclusion.

Federal law guarantees a safety net. A student moving from Massachusetts to a state with fewer resources still has their core rights protected.

Who Pays for the Promise?

When Congress passed the Individuals with Disabilities Education Act (IDEA) in 1975, it made a massive promise: to help pay for the high cost of special education. Congress authorized the federal government to pay up to 40% of the extra cost of educating eligible students.

The Federal Promise (1975)

Congress pledged to cover nearly half of the specialized services to reduce the burden on local taxpayers and state budgets.

The Funding Reality Today

~13% OF ACTUAL COSTS

The federal government has never funded more than 18%. Today, it averages 13-15%, leaving local communities to pay the rest.

This shortfall creates what civics experts call an unfunded mandate: a federal requirement that states must follow by law, but without the necessary funding to cover the costs.

How Massachusetts Fills the Gap

~13% Federal Grants Congress provides direct aid under IDEA.

~35% State Aid MA "Circuit Breaker" funds high-cost services.

~52% Local Taxes Towns pay with local residential property taxes.

Behind the Legal Paperwork: Three Real Students

Special education is not just about laws, state standards, or tax dollars. It is about human beings. Read these three real student profiles below and think about what accommodations or specialized services are necessary to allow them to thrive.

MAYA 8th Grade Student

IEP

Diagnosis: Dyscalculia (Severe Math Disability)

Maya understands advanced logic, history, and scientific concepts. However, written numbers and math equations become entirely scrambled in her mind. She needs a special education teacher to break down math steps and a customized curriculum to learn at her own pace.

LEO 8th Grade Student

504 Plan

Diagnosis: Severe ADHD & Sensory Processing

Leo is highly creative and excels in writing. However, he is extremely distracted by noise and fluorescent lighting, which gives him severe headaches and prevents him from finishing tests. He does not need a specialized curriculum, but he requires a quiet space, ear-muffs, and extra time.

SAM 8th Grade Student

TEMPORARY 504 PLAN

Diagnosis: Broken Collarbone & Dominant Arm Injury (Temporary 504)

Sam had a severe skiing accident and cannot write or type for 8 weeks. Because this is a temporary physical impairment, Sam receives a Temporary 504 Plan. He does not require long-term special education (an IEP), but is legally entitled to temporary supports like a peer scribe, voice-typing tools, and help moving between classes.
